    Student Visa (subclass 500) What is Australian student visa? ​ A student visa in Australia will enable you to study in a CRICOS (Commonwealth Register of Institutions and courses for Overseas for Overseas Students) registered course on a full-time basis in a registered institution. As student visa holder, you and your dependent family members have permission to work in Australia. However, work conditions will be applied to your student visa. ​ ​ What are the requirements for an Australian student visa? ​ To be eligible to apply for the student visa you must meet the following key requirements: Be at least 6 years old Have an Australian institution accepted you to study Hold a health cover ​ ​ Which documents are required to apply for a Student visa? ​ The Student visa document’s checklist is specific to each applicant and depends on the country of passport and education provider. These checklists are updated twice a year and so must ensure that the most updated list is being used. ​ ​ Further eligibility criteria to apply for a student visa ​ You must be accepted to a full-time study at an educational institution in Australia. ​ In case you are younger than 18 years old, there must be appropriate welfare arrangement for the duration of your stay as a student in Australia. ​ 1. Enrolment Requirement ​ You must enrol in the course of study that is registered on the Commonwealth Register of Institutions and courses for Overseas for Overseas Students (CRICOS). There are limited options for exceptions. ​ If you are applying from outside Australia, you must include a Confirmation of Enrolment (CoE) for each intended course of study with your visa application (a letter of offer from your education provider will not be accepted). ​ You must make sure all the CoE codes are mentioned on the application form for the courses to be included in your application. ​ You won’t need to add a CoE to your application in the following situations: ​ If you are sponsored by the Australian Department of Foreign Affairs and Trade – you must provide a letter of support If you are sponsored by the Australian Department of Defence – you must provide a letter of support If you are a secondary exchange student – you must provide an Acceptance Advice of Secondary Exchange Student (AASES) form If you are a postgraduate research student required to remain in Australia for marking of your thesis – you must provide a letter from your education provider ​ If you are applying for a student visa from Australia, you can apply with one or more Letters of Offer, but for your visa to be granted you must provide the CoE. ​ 2. Genuine Temporary Entrant (GTE) Requirement ​ You must proof you hold a genuine intention to study temporarily. This requirement is an integrity measure to ensure you won’t maintain ongoing residency in Australia. A personal statement in English addressing this requirement must be attached to the application. As part of the GTE, some of the following criteria will be checked - your country of residence circumstances, your potential circumstances in Australia, the course’s value to your future, your immigration history, etc. The GTE requirement applies to all student visa applicants. ​​ 3. English Language Requirements ​ Some of the student visa application streams need to be supported by English language skills. In case you are required to provide English exam evidence but don’t do it, this can cause your application to be refused ​ The test must have been taken not more than two years before you apply. ​ This table provides the minimum score you must obtain for a Student visa application: 4. Financial capacity Requirement For some of the student visa streams, you are required to attach evidence of financial capability to support your application. You must show your ability to access funds to pay for your course fees, travel and living costs for yourself and each of your accompanying family members while you are in Australia. ​ If demonstrating the financial capacity is required by your visa type, the financial evidence must be attached to the visa application form or your application could be refused. ​ Please be aware that student application streams who don’t have the financial capacity requirements, can still be asked to provide it by Department of Home Affairs during the application process. ​ If you are a secondary exchange student stream, you should provide a completed Acceptance Advice of Secondary Exchange Student (AASES) form as evidence of meeting the financial capacity requirement. ​ If you are sponsored by the Department of Foreign Affairs and Trade or Department of Defence you should provide a letter of support as your financial evidence. The letter won’t cover accompanying family members, and you will have to provide evidence of financial capacity for them. ​ ​ What can be counted as evidence of financial capacity? ​ Evidence of funds to cover travel to Australia and 12 months’ living, course and schooling costs (for school-aged dependants) for you and your accompanying family members Evidence that you meet the annual income requirement – either using personal / your parent / your de facto / spouse funds An Acceptance Advice of Secondary Exchange Students (AASES) form (secondary exchange students only) A letter of support from the Department of Foreign Affairs and Trade or Department of Defence. Student visa subsequent entrant - financial capacity requirements A family member who applies after the primary applicant has been granted their visa must also provide documentary evidence for financial capacity. This must be one of the options mentioned above. ​ 5. Health Requirement and Health cover As part of the health requirements, you might need to take a medical examination. You must hold an Overseas Student Health Cover (OSHC) which provides medical and hospital insurance in Australia while being in Australia. ​ 6. Character Requirement ​ Every applicant for any visa to Australia will be assessed against the character requirement and must demonstrate good character. You must answer all the questions on the application form regarding your character as accurate as possible and declare any pending or previous character issues. ​ 7. Pre-Qualifying visas ​ To be eligible for applying to a student visa from Australia, you must hold a temporary substantive visa (which is any visa other than a bridging visa, criminal justice or enforcement visa, which allows the holder to remain temporarily in Australia) and should not hold the following visas: ​ ​ Domestic Worker (Temporary) Diplomatic and Consular visa (subclass 426) Temporary Work (International Relations) visa (subclass 403) in the Domestic Worker (Diplomatic or consular) stream Diplomatic (Temporary) visa (subclass 995) - primary visa holder only. This means a family member of a Diplomatic (Temporary) visa (subclass 995) can apply for a Student visa in Australia. Transit visa (subclass 771) Visitor visa (subclass 600) in the Sponsored Family stream or in the Approved Destination Status stream. ​ In limited circumstances, if your student visa has expired within the last 28 days, you might be able to apply for your new student visa in Australia. ​ Please be aware that you can use this benefit once only! ​ 8. Adding family members to join your student visa ​ Your family members can join you when applying for your student visa application (combined application) or apply to join you later once you already hold the student visa provided you declared about them in your student visa application, or they became a family member after the grant of your student visa (such as a newborn baby). You must have funds to support yourself and all accompanying family members already in Australia as well as those included in the current application. ​ 9. English Language Intensive Course for Overseas Students (ELICOS) ​ ​ You can apply to study in ELICOS Australia. If you intend to study standalone ELICOS for more than 12 months, you should provide lots of information with your application showing how you meet the Genuine Temporary Entrant (GTE) requirement. ​ There is flexibility to extend the length of ELICOS where it is needed.     Provisional Partner visa (subclass 309) and Migrant Partner visa (subclass 100) - offshore Who should apply for Partner Visa? ​ A partner or a spouse of Australian Permanent Resident, Australian Citizen or eligible NZ citizen. ​ ​ What is the eligibility criteria for Partner visa? ​ Applicant must be married or in a de-facto relationship with Australian Citizen or Permanent resident or Eligible NZ Citizen. Your Australian sponsor needs to be 18 years old and above. In certain circumstances, the sponsor can be younger than 18. The marriage must be valid under the Australian law (ages 16 and 17 must seek parental approval) A couple in a de-facto relationship must be able to prove that the relationship is valid for at least 12 months before submission. (registered relationship exempted) You must be outside Australia at the time of submission and the grant of the temporary visa. You can be inside or outside Australia for the submission and grant of the permanent visa. The applicant can include dependent children and stepchildren in the application.     Skills Assessment If you are interested in applying for most Australian Permanent Work visas (e.g. all GSM visas , Employer Nomination Scheme (subclass 186) via the Direct Entry stream) you should hold a positive skills assessment from the relevant assessing body. Some temporary Australian work visas will also require applicants to hold a positive skills assessment (depending on the occupation and nationality of the visa applicant) as part of the eligibility criteria. If you apply for these visas without a positive skills assessment, your application will be refused. ​ Here are the main assessment bodies which are authorised to conduct skills assessment: ​ Australian Computer Society (ACS) ACS is the authorised assessing authority that undertakes skills assessment for skilled migration. ACS assess the skills and qualifications of ICT professionals who are considering migration to Australia to work in the Information and Communications Technology (ICT) sector. ​ ACS Assessment time: A complete assessment will take 10-12 weeks. All applications are processed as soon as possible. The processing time will depend on the quality of the documentation and information provided. ​ ​ Vocational Education and Training Assessment Services (Vetassess) Vetassess is the authorised body chosen by the Department of Home Affairs to assess a wide variety of Professional Occupations as well as Trade Occupations for different visa types like point test advice, Chinese qualifications verifications, training plans and more. TRA Assessment time: MPA applications are generally are finalised within 120 days from your online submission. Architects Accreditation Council of Australia (AACA) AACA is the authorised assessing authority which underpins all assessment processes, including the accreditation of Architecture programs leading to registration as an Architect in Australia. AACA Assessment time: Generally, it takes a maximum of 12 weeks to process applications once complete applications are received. Australian Institute for Teaching and School Leadership (AITSL) AITSL provides skills assessment services to Teachers who wish to migrate to Australia. A skills assessment determines suitability for School Teacher occupations for Australia's skilled migration program. ​ AITSL Assessment time: The standard assessment time is 10 weeks from the date of AITSL's initial notification email. ​ ​ Recognition of Prior Learning (RPL) ​ For some occupations, there is an option to get accredited based on years of experience in the profession with lower to none formal qualification requirements. The process often requires an extensive set of evidence and in some cases requires a technical test and even a demonstration of the skills. ​ How do I know which skills assessment body to use? ​ There are many different professions listed in the Migration Regulation. Each occupation has a unique set of tasks which defines that occupation. Each occupation has one assessment body which is authorised to provide the skills assessment to that specific occupation. ​ ​ Don't risk your skills assessment ​ There are strict requirements to be granted a positive skills assessment. There is high significance to the employment experience, type of qualification, certifications and their origin, and the content of the reference letters. These requirements are specific to each profession and often will vary between assessment bodies. ​ When applying for a skills assessment, you want the assurance that the person who is guiding you is experienced with dealing with the relevant assessing body and preferably already got positive results for the same profession. ​ We have many years of experience supporting our clients in applying for their skills assessment and receiving favourable outcomes. You must be outside Australia to apply for your first Working Holiday visa and when it is decided. Education requirements – this requirement changes upon the different passport holder nationality. English requirement – you must provide evidence that you have at least functional English. Letter of government support – some nationalities require to provide letter of support from their government (countries which are exempt from providing the letter – USA, Singapore, Israel and China). ​ ​ How long am I allowed to work while holding this visa? ​ This visa will allow you to work for one employer for six months only. You will be able to extend your work only after given permission by the Department of Home Affairs to work longer. As from 5 November 2018, a 462 visa holder can stay with the same agricultural (plant and animal cultivation) employer for up to 12 months. Plant and animal cultivation includes most agricultural work, such as: ​ Harvesting and/or packing of fruit and vegetable crops Pruning and trimming vines and trees General maintenance crop work Cultivating or propagating plants, fungi or their products or parts Immediate processing of plant products Maintaining animals for the purpose of selling them or their bodily produce Immediate processing of animal products including shearing, butchery, packing and tanning Manufacturing dairy produce from raw material ​ Applying for your first Work and Holiday visa – besides applicants from the US who can apply online, all other applicants from the eligible countries list must apply by post or in person to a specific Australian Immigration Office or Australian Visa Application Center. ​ ​ The second and third year of Work and Holiday visa ​ ​​ To be eligible to apply for the second year of 462 visa, you must provide evidence for completing three months (minimum of 88 calendar days) of work in Northern Australia or Western Australia in these specific industries - tourism, hospitality, agriculture, forestry or fishing while holding your first Work and Holiday visa.     General Skilled Migration (GSM) Visas What is a GSM Visa? ​ The GSM visa is relevant for experienced, skilled migrants who hold an occupation in demand in Australia and together with the members of their family unit would like to live, work or study in Australia permanently. ​ Three sub classes can be found under the GSM category: ​ Skilled Independent visa - subclass 189 Skilled Nominated visa - subclass 190 Skilled Work Regional (Provisional) visa - subclass 491 ​ Before applying for any of the visas under the GSM category, you must apply via the SkillSelect Program and submit your Expression of Interest (EOI). ​ ​ What is EOI? ​ EOI is an online system which helps the Australian Government to monitor and select the best candidates in each occupation lists of the relevant visas based on the Australian market needs. ​ Your EOI application can be accessed by Australian employers and by the states and territory governments. If your EOI application matches their needs, you will be invited to apply for a visa. ​ Once invited to apply for a GSM visa, you must submit your visa within 60 days or your invitation will expire. ​ The EOI application is a point-based system, therefore each applicant must achieve at least 65 points to be able to apply for EOI. In most cases, due to the high demand for each occupation, a higher score is required to receive an invitation for a GSM visa. ​ It is important to notice that your EOI application stays active for up to two years. ​ ​ How to calculate points for the EOI? ​ Based on the point system - the higher the score you can achieve on the EOI, will increase your chances to receive an invitation to apply for a GSM visa. ​ There are two main sections for accumulating points for the EOI: ​ The mandatory section, which the candidate must satisfy the minimum requirements but will get additional points for exceeding them. ​ The second section, which the candidate can accumulate extra points based on their personal circumstance, qualifications and professional experience. ​ Here is the breakdown of the two sections: The following categories are required for the EOI application ​ Age – You must be younger than 45 when invited to apply for the GSM visas. Age exemption might be accepted in some instances. English level – You must hold at least a competent English level to apply for any GSM visas. Proficient or Superior English level will award extra points. Occupation – you must hold an occupation within the occupation list of the specific visa applying for under the GSM visas. Skills Assessment – you must hold a positive skills assessment approved by the relevant Australian assessing body for your nominated occupation. ​ The following categories can help add points to the EOI score ​ Work experience - you can collect points from either overseas work experience or Australian work experienced (or both). The more experienced you are, the more points you can gain against this criteria. Qualification - you can collect points from your overseas / Australian qualifications. Local Australian studies - applicants who studied in Australia beyond 92 weeks can gain points as well as for studies which took place in rural areas in Australia. Studying in regional area in Australia - you can collect 5 points if you studied in regional areas in Australia. Designated Language - relevant for NAATI translators and Interpreters professionals Having a partner or a single status - you have several options to gain points if you have a partner or if you are single. Applying for a 190 visa will provide you with extra 5 points. Applying for a 491 visa will provide you with extra 15 points.     TSS 482 visa - Temporary Skill Shortage What is a TSS 482 visa? ​ The TSS 482 visa is available for an applicant who wants to live on a temporary basis in Australia and work full time for the sponsoring employer in the nominated position. (TSS 482 visa is the replacement of the 457 visa ) Applicants for 482 visa may include dependent family members in their application. Applying for the 482 visa has three steps - Sponsorship, Nomination and Visa application. ​ ​ Who can apply for TSS 482 visa? ​ To apply for a TSS 482 visa, you must be an overseas skilled worker which means your occupation must be included within the relevant occupation list and you must have an employer (the sponsor) who agrees to hire you. Your member of the family unit can join your 482 visa application. ​ ​ What are the steps to get a TSS 482 Visa? ​ The TSS 482 visa involves a three-step process: ​ Step 1: Sponsorship application by the employer Step 2: Nomination application for a skilled position by the employer Step 3: 482 Visa application by the proposed employee ​ Sponsorship Before you can apply for a TSS 482 visa, your proposed employer will need to lodge a nomination application for you. They will only be able to do it if they are an approved sponsor or have at least lodged an application to become a standard business sponsor. The cost of a sponsorship application is AUD 420, and the sponsorship is valid for five years from the date it is approved. ​ Nomination ​ Existing approved sponsors or applicants to be an approved sponsor can nominate an overseas worker for a particular position in their organization/workplace. ​The cost of a nomination application is AUD330, and all relevant documents must be attached while submitting the nomination application. ​ The nomination is generally valid for up to 12 months from the nomination approval date, or until the earliest of the following occurs: ​ Your 482 visa is being approved. If there is a request to withdraw the nomination application - the day The Department of Home Affairs receives your written notification to withdraw the nomination application. Three months after the completion date of the standard business sponsorship unless a new sponsorship application was lodged before that ceasing date and it remains unfinalized. The day on which the approval as a sponsor is cancelled. The day on which the labour agreement ceases. ​ TSS 482 Visa ​ There are three optional streams for this visa type: Short-term stream Medium-term stream Labour agreement stream ​ Eligibility criteria for Short-term stream ​ Your occupation must be included on the Short-term Skilled Occupation list (STSOL) for a TSS 482 visa. You have worked in your nominated occupation, or a related field, for at least two years before applying for the 482 visa. You must be aware that it is a short-term visa and agree to enter and stay as a short-term visa holder (known as a 'Genuine Temporary Entrant' (GTE). You will be working directly for your employer (the sponsor) or an associated entity of your sponsor. Your visa will usually be for maximum two years or four years if an International Trade Obligation (ITO) applies. You must meet the English language requirements described below. ​ Eligibility criteria for Medium-term stream ​ Your occupation is listed on the Medium and Long Term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL) for a 482 visa. You have worked in your nominated occupation, or a related field, for at least two years before applying for this visa. You will be working directly for your employer (the sponsor) or an associated entity of your sponsor. Some of the medical occupations are exempt from this requirement. You must meet the English language requirements described below. ​ Eligibility criteria for Labour agreement stream ​ In this specific stream, the future employer has entered into a labour agreement with the Department of Home Affairs and interested to sponsor an overseas worker. You will be eligible to apply under this stream if your occupation is included in a labour agreement which your employer has entered into with the Department. ​ Moreover, you have worked in your nominated occupation, or a related field, for at least two years before applying for this visa. (unless this is not required under the labour agreement). ​ You must also meet the English language requirements described below. ​ ​ What you need to know about TSS 482 visa before applying? ​ This visa allows you to travel to and from Australia for the duration of your visa and for the primary visa holder, to work in Australia for an approved sponsor in his nominated occupation. The visa allows the family member of the main applicant to work and study in Australia. You must be nominated for a position by an approved sponsor, and that nomination has been approved. Applicants who have specific occupations are required to hold a positive skills assessment at the time their 482 application is submitted. Particular occupations are required to have a skill assessment while others don’t. The Department is also able to use its discretion to request a skills assessment as part of the visa application process even where it is not mandatory. You can apply to a 482 visa while being in Australia only if you hold the following visa types: hold a substantive visa /a subclass 010 (Bridging A) visa/ a subclass 020 (Bridging B) visa or a Subclass 030 (Bridging C) visa. You can apply for 482 from outside Australia as well. You must comply with any conditions that apply or applied to your last visa to get your 482 visa approved. Every applicant for the 482 visa is obligated to meet health and character requirements. There is no age requirement for this visa. To meet the two years experience required for the 482 visa, you must verify that your work experience should have been undertaken on a full-time basis in the last five years. This period does not, however, need to be continuous. Members of your family unit can be added to 482 visa application of the primary applicant. Applicants holding a substantive visa with a no further stay condition might still be able to lodge an application in Australia for this visa in certain circumstances. ​ ​ What are the English language requirements for TSS 482 visa? ​ Short-term stream For the short-term stream, the required results are as follows: IELTS overall band score of at least 5.0 with a score of at least 4.5 in each of the test components. OET score of at least ‘B’ in each of the four components TOEFL iBT total score of at least 35 with a score of at least 3 for each of the test components of listening and reading, and a score of at least 12 for each of the test components of speaking and writing PTE Academic overall test score of at least 36 with a score of at least 30 in each of the test components CAE overall test score of at least 154 with a score of at least 147 in each of the test components Medium-term stream ​ For the medium-term stream, the required results are as follows: IELTS overall band score of at least 5.0 with a score of at least 5 in each of the test components OET score of at least 'B' in each of the four components TOEFL iBT total score of at least 35 with a score of at least 4 for each of the test components of listening and reading, and a score of at least 14 for each of the test components of speaking and writing PTE Academic overall test score of at least 36 with a score of at least 36 in each of the test components CAE overall test score of at least 154 with a score of at least 154 in each of the test components Labour agreement stream ​ You must demonstrate the level of English language proficiency specified in the Labour agreement. ​ ​ Who can be exempted from the English language requirements evidence for TSS 482 visa? ​ You are not required to demonstrate your English language proficiency if you fall into one of the following categories: You hold a passport from the following countries - Canada, New Zealand, the Republic of Ireland, the United Kingdom or the USA. You have completed at least five years of full-time study in a secondary or higher education institution where instruction was conducted in English. You are nominated for an occupation which will be performed at a diplomatic or consular mission of another country or an Office of the Authorities of Taiwan located in Australia. You are an employee of an overseas business which is coming to Australia to work for that company or their associated entity, and the position has guaranteed annual earnings of at least AUD96,400. Your occupation requires you to hold a licence, registration or membership and: To be granted that licence, registration or membership you must demonstrate a level of English language proficiency that is equivalent to or better than the level described for Short-term stream or Medium-term stream, and you have been granted that licence, registration or membership. ​ ​ What is the processing time for the various TSS 482 visa streams? ​ Short-term stream from 19 days to 40 days. Medium-term stream from 15 days to 28 days.
